摘 要:碳排放权作为大气环境管理的手段,对于实现碳达峰碳中和目标具有重要意义。我国从试点开始现已逐步建立全国碳排放权交易制度,但对于碳排放权的法律属性尚无定论。碳排放权的设定过程本质是一种行政许可,即通过核定的配额取得,具有公法的性质;而通过对碳排放权实施机制的分析可知其也符合社员权的特征,具有私法的性质。明确碳排放权的双重属性,有助于扩大交易主体,创新交易平台机制,激发一级市场和二级市场的流动性和交易活力,实现市场调控和政府监管之间的平衡。As a means of atmospheric environment management,carbon emission rights are of great significance for achieving the goal of carbon peaking and carbon neutrality.Since the pilot project,China has gradually established a national carbon emission trading system,but there is no conclusive conclusion on the legal nature of carbon emission rights.The assignment procedure of carbon emission rights is in nature an administrative license,which is obtained through approved quotas with the character of public law.But the analysis of the implementation mechanism of carbon emission rights enables us to know that it also conforms to the characteristics of social rights,embodying the nature of private law.Therefore,clarifying the dual attributes of carbon emission rights can help expand trading entities,innovate trading platform mechanisms,stimulate liquidity and market vitality in primary and secondary trading markets,so as to achieve a balance between market regulation and government regulation.
