制度创新的条件及实现路径——基于政府、市场、社会的协商共治经验

摘　　要：社会的发展进步,往往是通过一系列制度创新来推动和实现的,中国改革开放的本质正是制度创新。制度创新不是为创新而创新的“折腾”,也不是换汤不换药的花样翻新,而是基于发展和治理需求导向的解决方案的探索,是基于社会共识而构建新规则,以实现更有秩序、更有效率、更加公平的社会公共生活为目标。制度创新是许多力量共同作用的结果,政府、市场、社会三者多元共治,被认为是协同治理的理想状态。本文从政府、市场、社会互动博弈的角度分析制度创新的条件和实现路径。研究认为,制度创新可分三个阶段,即博弈阶段、共识阶段和实现阶段,相对应地,其实现需要满足三个“有效”条件,即多元博弈机制的有效运转、制度主体共识的有效达成、符合共识制度安排的有效供给。为推动制度创新的实现,应建立多元博弈机制,凝聚最广泛社会共识,激励解决方案的创新设计与试验,增加有效制度供给,才能带来制度效能的显著提升。Social development and progress are often promoted and realized through a series of institutional innovation,which is essentially the nature of China's reform and opening up.Institutional innovation is not a"flip-flop"of innovation for innovation's sake,nor is it just"old wine in a new bottle".Instead,it is an exploration of solutions based on the demand of development and governance,and it is the establishment of new rules based on social consensus,with a view to achieving a more orderly,efficient and equitable public social life.institutional innovation is the result of combined action of many forces.The government,market and society are pluralistic and co-governed,and it is regarded as the ideal state of collaborative governance.This paper analyzes the conditions and realization path of institutional innovation from the perspective of interactive game among government,market and society.This research holds that institutional innovation can be divided into three stages,namely game stage,consensus stage and realization stage.Correspondingly,its realization needs to meet three"effective"conditions,that is,the effective operation of the multi-game mechanism,the effective consensus achievement of institutional subjects,and the effective supply in line with the institutional arrangement consensus.In order to promote and foster the realization of institutional innovation,it is necessary to establish a multi-subject game mechanism,build the most extensive social consensus,encourage innovative design and experiment of solutions,and increase effective institutional supply.Only in this way can the system efficiency be significantly improved.
