数字经济时代知识产权司法鉴定制度的发展与完善

摘　　要：知识产权司法鉴定是知识产权保护不可缺少的专业技术支撑。改革开放40多年来,我国知识产权司法鉴定制度历经了基础奠定、初步设立、快速发展、清理退出和探索重建四个发展阶段。数字经济时代,知识产权保护工作中专业技术支撑的需求与日俱增,知识产权司法鉴定制度具有显著的制度优势和结构功能,并受国家高度重视,因而具备正当性。然而,法制保障、管理体制等方面的不足制约了知识产权司法鉴定制度的发展。为提升数字经济时代知识产权保护质效,加快知识产权强国建设,建议加强政策保障,开展知识产权司法鉴定制度创新试点工作,并围绕立法推进、机制配套、信用监管等方面对知识产权司法鉴定制度进行完善。Intellectual property judicial expertise is an indispensable professional and technical support for intellectual property protection.In the past 40 years of reform and opening up,China’s intellectual property judicial authentication system has gone through four stages of development:foundation laying,initial establishment,rapid development,liquidation and reconstruction..In the era of digital economy,the demand for professional technical support in intellectual property protection is increasing day by day.The judicial authentication system of intellectual property has significant institutional advantages and structural functions,and is highly valued by the state,so it has legitimacy.However,the lack of legal protection and management system restricts the development of intellectual property judicial appraisal system.In order to improve the quality and effectiveness of intellectual property protection in the digital economy era and accelerate the construction of a strong intellectual property country,it is recommended to strengthen policy guarantee,carry out pilot work on innovation of intellectual property judicial authentication system,and improve the intellectual property judicial authentication system in terms of legislative promotion,supporting mechanisms and credit supervision.
