论南极旅游环境保护基金制度之构建——兼析中国的因应之策

摘　　要：现有制度在执行层面的不足和南极旅游环境治理的乏力呼吁着南极旅游环境治理制度之革新。作为应时之需而提出的新制度,根植于环境正义的南极旅游环境保护基金制度或可弥补现有制度在执行层面的不足,助力南极旅游环境的治理。制度的适用对象、运行及责任机制是南极旅游环境保护基金制度的架构支撑。其中,南极旅游环境保护基金制度的运行及责任机制由基金的支付机制、收缴机制、使用机制和制度的责任机制组成。作为因应之策,我国可在立足国家利益的基础上推动制度的设立、建立,并优化国内南极旅游行政许可制度的内部建设,为世界贡献转化立法的中国方案。The insufficiency of the existing system in the implementation level and the weakness of Antarctic tourism environmental governance require the innovation of the Antarctic tourism environmental governance system.As a new system proposed in response to the needs of the times,the Antarctic tourism environmental protection fund system rooted in environmental justice may make up for the insufficiency of the existing system at the implementation level.Additionally,the system can optimize the environmental governance of Antarctic tourism.The applicable objects and the operating mechanism of the system are the structural support of the Antarctic tourism environmental protection fund system.The operating mechanism of the Antarctic tourism environmental protection fund system consists of the payment mechanism,the collection mechanism,the use mechanism and the responsibility mechanism of the system.As a response,China can promote the establishment of the system on the basis of national interests,and establish and optimize the internal structure of the domestic Antarctic tourism administrative licensing system,offering the Chinese plan of transformational legislation for the world.
