论担保物权的破产别除效力

摘　　要：为实现多元化的价值目标,现代破产法对担保物权予以全面的程序限制,担保物权无法彻底别除于破产程序之外,破产别除权演化为担保物权的破产别除效力。在债务人提供物权担保的情形下,担保物权优先受偿所依赖的财产基础是归属于债务人的担保财产,其属于破产财产范畴。担保物权与破产债权相叠加,构成物权担保债权,债务人在破产程序中的物权担保债权应被纳入破产债权之中,适用破产债权加速到期的规则。在此观点的基础上,物权担保债权人原则上应当享有普通破产债权人的破产程序权利,负担相应的破产程序义务,但须根据担保物权的特点作出必要的调整。物权担保债权人应享有申请债务人破产的权利,承受申报破产债权的义务,具有参与债权人会议的资格。In order to realize the value goal of diversification,the modern bankruptcy law gives comprehensive procedure restriction on the real rights for security.The real rights for security cannot be completely excluded from the bankruptcy procedure,and the bankruptcy exemption right evolves into the bankruptcy exemption effect of the real rights for security.In the case that the debtor provides the security for real rights,the property basis on which the priority compensation of the real rights for security depends is the security property belonging to the debtor,which belongs to the category of bankruptcy property.The superposition of the real right for security and the claim in bankruptcy constitutes the claim secured by real rights,which in the debtor's bankruptcy procedure should be included in claims in bankruptcy,and the rule of accelerated maturity of claims in bankruptcy should be applied.Based on this point of view,the creditor of security of real rights should in principle enjoy the right of bankruptcy procedure and bear the corresponding obligation of bankruptcy procedure,but it should make necessary adjustment according to the characteristics of real rights for security.The creditor of security of real rights shall have the right to apply for the debtor's bankruptcy,bear the obligation to declare the creditor's right of bankruptcy,and be qualified to participate in the creditors'meeting.
