宪法生态文明规范体系对环境法典编纂的制度化依据——以《立法法》第二次修改为背景的探讨

摘　　要：“根据宪法,制定本法”是立法的最根本要求;2023年3月,《立法法》第二次修改,明确指出“立法应当符合宪法规定”;据此,通过2018年修宪形成的宪法生态文明规范体系是环境法典编纂的宪法依据。该体系以生态文明为宪法核;通过对环境法典进行名称确定、性质厘定以及范围限定等构成了环境法典编纂的外部制度化依据;通过将生态文明确定为环境法典的核心理念并在此基础上凝练显性主线确定环境法典的框架内容,以及将环境权证成为环境法典的隐性主线等构成了环境法典编纂的内核制度化依据。外部制度化依据为环境法典的编纂塑形,内核制度化依据为环境法典的编纂铸魂。在环境法典编纂过程中,确定宪法依据到底是什么,以及到底产生什么样的制度化依据,进而形成系统全面的诠释及建议,是宪法学者可以为环境法典编纂做出的学术贡献,也是构建中国宪法学自主知识体系的有益探索。"Enact the Law in Accordance With the Constitution"has specific normative implications.The second amendment to the Legislation Law made it clear that legislation should conform to the Constitution,According to this principle,the ecological civilization normative system in the Constitution is the constitutional basis for the compilation of environmental code.The system takes ecological civilization as its constitutional core.They constitute the external institutional basis for the compilation of the environmental code by the ecological civilization norm system of the constitution,by determining the name,nature and scope of the environmental code etc.They constitute the internal institutional basis of the compilation of the environmental code by taking the ecological civilization as the core idea,forming the dominant principle line and confirm the frame content of the environmental code on this basis,and the casual principle line of proving the environmental right as the environmental code etc.In the compilation process of environmental code,confirming what the constitutional basis is,what the institutional basis will be,and providing a full range of interpretation and advice,are the real contributions of environmental code enacting that constitution scholars can do,and a useful exploring of forming the independent knowledge system of Chinese Constitutional law.
