犯罪标签理论的再发展及其当代价值

摘　　要：标签理论发源于符号互动理论,侧重于从外界刺激与行为反应的互动视角考察犯罪。进入21世纪以来,随着社会环境的变化与社会理念的革新,人们更加关注定罪量刑对犯罪人产生的负面效应,围绕犯罪标签产生不利影响的内在机制研究、犯罪记录产生的长期标签效应以及针对犯罪记录标签效应的改革探索不断推进。标签理论对我国当前的犯罪治理具有借鉴价值:为消解刑罚及其附随后果的不利影响,我国应当补充建构复权、前科消灭等刑罚消灭制度;针对数量攀升的轻罪案件,应当加强落实“少捕慎诉慎押”的刑事司法政策,创新行刑衔接机制、发展监禁替代措施,并对轻罪案件建立犯罪记录封存制度。此外,标签理论也为我国当前的企业刑事合规工作提供了犯罪学的解释路径。The labeling theory originated from the symbolic interaction theory,focusing on the investigation of crime from the perspective of interaction between external stimuli and behavioral responses.Since the beginning of the 21st century,with the changes in the social environment and the innovation of social concepts,people have paid more attention to the negative effects of conviction and sentencing on criminals,the research on the internal mechanism of the adverse effects of criminal labels,the long-term labeling effects of criminal records and the reform and exploration of the criminal record labeling effect are continually to be advanced.The labeling theory has reference value for China’s current crime governance:in order to eliminate the adverse effects of penalties and their attendant consequences,China should supplementally construct penalty elimination systems such as restoration of rights and elimination of previous convictions;for the rising number of misdemeanor cases,the implementation of the criminal justice policy of“fewer arrests,careful prosecution and careful detention”should be strengthened,the execution connection mechanism should be innovated,the alternative measures to imprisonment should be developed,and the criminal record sealing system for misdemeanor cases should be establishment.In addition,the labeling theory also provides a criminological interpretation path for China’s current criminal compliance of enterprise.
