村规民约中责任条款的效力——以黔东南的民族村寨为例

摘　　要：在民族村寨的村规民约中,既有传统习惯规则处罚方式,也有现代的责任方式。对于责任条款的效力,在理论和实践中还存在不同的认识。村规民约中责任条款不能一概认定为违约责任或者处罚,而是根据内容区分其性质判断责任条款的效力。村规民约中的责任条款包括调整不平等关系的社会自治规范以及平等关系的契约。民事契约部分的效力取决于是否违反《民法典》关于合同无效的规定,而责任条款中调整村级组织与村民之间的不平等关系的部分,属于社会自治规范,其效力取决于规定的事项是否属于村民自治事项,以及是否处置了村民不能让渡的权利。In the village regulations of ethnic villages,there are not only the punishment methods of traditional customary law,but also modern responsibility methods.However,there are different views on the validity of liability clause in practice and theory.The liability clauses in the village rules cannot be collectively recognized as liability of contract or punishment.The validity of the liability clauses is judged according to their nature.The responsibility clause in the village regulations includes the social autonomy norm to adjust the unequal relationship and the contract to adjust the equal relationship.The validity of the civil contract part depends on whether it violates the provisions of the Civil Code on the invalidity of the contract.The validity of the social autonomy norm part depends on whether the stipulated matters belong to the matters of the villagers'autonomy and whether the villagers'inalienable rights are affected.
