中外承认离婚判决制度比较

摘　　要：对外国离婚判决的承认是外国判决承认中的一个特类,许多国家都对其有专门的规定。我国最高人民法院就颁布了《关于中国公民申请承认外国法院离婚判决程序问题的规定》和《关于人民法院受理申请承认外国法院离婚判决案件有关问题的规定》进行专门规定,欧盟也先后形成了《布鲁塞尔公约Ⅱ》和《布鲁塞尔条例Ⅱa》,对婚姻判决的承认做出了专门的规定。通过中外承认离婚判决制度比较,可以发现法国、德国、日本等不同国家对离婚判决的承认各有特点和优点,值得学习和借鉴。The recognition of foreign divorce judgments is a special category of foreign judgments recognition,and many countries have special provisions for it.The Supreme People’s Court of China has promulgated the“Provisions on the Procedural Issues of Chinese Citizens Applying for Recognition of Divorce Judgments of Foreign Courts”and“Provisions on Issues Related to the Acceptance of Applications by People’s Courts for Recognition of Divorce Judgments of Foreign Courts”,and the EU has also successively formed the Brussels Convention II and the Brussels Regulation II.a to make special provisions on the recognition of marriage judgments.Through the comparison of the Chinese and foreign recognition of divorce judgment systems,it can be found that the recognition of divorce judgments in different countries,such as France,Germany,and Japan,have their own characteristics and advantages,which are worth learning.
