实施“强迫劳动公约”背景下的我国劳动法治建设

摘　　要：全国人大常委会审议批准了国际劳工组织《1930年强迫劳动公约》和《1957年废除强迫劳动公约》两个国际劳工公约,这是我国政治生活中的大事,随着两个公约的实施,还将对我国劳动法治建设产生重大影响。为此,需要对国内禁止强迫劳动的有关规则进行系统梳理,尽快实现公约内容向国内政策和法律法规的转化,以采取国际公认的统一标准来调节我国劳动关系。同时,科学界定强迫劳动的构成要件与排除范围,加强监管,杜绝实践中的强迫劳动现象等,有效推进两个公约在我国的实施。The Standing Committee of the National People's Congress reviewed and ratified two international conventions against forced labor,the International Labor Organization's Forced Labor Convention,1930 and the Abolition of Forced Labor Convention,1957,which was a significant event in China's political life.Along with the implementation of the conventions,it will have a significant impact on the construction of China's labor-related legal system.Therefore,it is essential to sort out relevant domestic rules prohibiting forced labor systematically,accomplish the transformation of the content of two conventions into domestic policies,laws and regulations as soon as possible to regulate labor relations in China by adopting internationally recognized unified standards.Simultaneously,it is crucial to scientifically define the elements of forced labor and the scope of exclusion,strengthen supervision and eliminate the phenomenon of forced labor in practice for the sake of effectively promoting the implementation of two conventions in China.
