摘 要:传统的命令控制型环境治理以政府为主导,有诸多弊端。公私合作环境治理则需要充分调动政府、市场和社会三要素,构建多元主体共同参与的环境治理模式,真正实现政府规制、社会自治和公众参与的有机结合。具体可从五个方面构建环境治理公私合作机制:政府环境权力下放转移机制、公民社会自治机制、治理主体的沟通协商机制、治理中的责任分配机制与利益冲突的法律救济机制。Traditional command-and-control environmental governance is government-led,while public-private partnership environmental governance needs to fully mobilize the three elements of government,market and society,construct multiple subjects to participate in environmental governance,and truly realize the organic combination of government regulation,social autonomy and public participation.Specifically,the public-private cooperation mechanism of environmental governance can be constructed from five aspects:the decentralization and transfer mechanism of government environmental power,the autonomy mechanism of civil society,the communication and consultation mechanism of governance subjects,the responsibility distribution mechanism in governance and the legal relief mechanism for conflicts of interest.
