我国农村非法种植毒品原植物犯罪的刑事治理研究

摘　　要：当前,我国农村地区非法种植毒品原植物犯罪呈现出犯罪人主要是文化程度较低的中老年农民、种植动机多样且种植地点较为隐蔽、种植品种单一的典型特点。非法种植毒品原植物犯罪的刑事治理存在犯罪识别难、司法适用标准统一难、犯罪故意认定难、程序规范难、犯罪治理效果巩固难的实践困境。为此,应当加快构建以刑事治理为中心的犯罪治理机制,采用高效行政治理筑牢刑法堤坝、精准化刑事治理打击犯罪、现代化基层社会治理巩固实效的可行路径,实现农村地区非法种植毒品原植物犯罪的长效治理。Currently,crimes of illegal cultivation of narcotic plants in rural areas of China are charactierized by middle and old farmers with low education level,diverse motives of planting,hidden planting locations and single planting varieties.There are some practical difficulties in criminal control of crime of illegal cultivation of narcotics plants.It is difficult to identify crimes,unify the standards of judicial application,identify criminal intent,standardize procedure,and consolidate the effect of criminal management.Therefore,we should speed up the construction of crime control mechanism centered on criminal control,consolidate the dam of criminal law by efficient administrative governance,fight against crimes by criminal control,strengthen the effectiveness by modernized grass-root social governance,to achieve the long-term management of illegal cultivation of narcotic plants in rural areas.
