重点排污单位自动监测数据造假排放污染物的司法适用——以《关于办理环境污染刑事案件适用法律若干问题的解释》第10条为视角

摘　　要：实践中,司法机关对重点排污单位篡改、伪造自动监测数据或者干扰自动监测设施排放污染物的定性争议较大。污染源自动监控系统与环境质量监测系统在监测主体、监测目的、监测内容等方面存在明显差异。重点排污单位自动监测数据造假不属于针对环境质量监测系统实施的犯罪,不能适用《关于办理环境污染刑事案件适用法律若干问题的解释》第10条,认定为破坏计算机信息系统罪。对重点排污单位自动监测数据造假排放污染物的认定,应围绕犯罪对象、犯罪行为、犯罪后果等要件,以罪责刑相适应和刑法谦抑性为内在遵循,综合考量确定。There is a significant controversy in judicial practice regarding the qualitative nature of key pollutant discharge units tampering with,falsifying automatic monitoring data,or interfering with the discharge of pollutants from automatic monitoring facilities.There are significant differences between the automatic monitoring system for pollution sources and the environmental quality monitoring system in terms of monitoring subjects,monitoring purposes,and monitoring content.The falsification of automatic monitoring data by key pollutant discharge units is not a crime committed against the environmental quality monitoring system,and cannot be recognized as the crime of damaging computer information systems under Article 10 of the Interpretation on Several Issues Concerning the Application of Law in Handling Criminal Cases of Environmental Pollution.The determination of the crime of destroying computer information systems through automatic monitoring data falsification and emission of pollutants by key pollutant discharge units should focus on the criminal object,criminal behavior,criminal consequences,and other elements,and be guided by the compatibility of criminal responsibility and punishment and the modesty of criminal law,and comprehensively consider the determination.
