利益平衡原则导向下区块链技术对版权集体管理保护机制的反思与重构

摘　　要：随着互联网的发展,传统的知识市场正发生天翻地覆的变化。网络上涌现出海量的数字版权作品,非会员版权人拥有巨大的创作活力,但窃取他人知识成果、知识产品侵权问题频发。面对这种挑战,传统的集体管理组织难以维持各方的利益平衡,陷入了利益分配不均的困境。研究发现,通过区块链技术能够实现数字时代集体管理组织在授权、流转、监管、竞争全过程的有效管理,建立全新的管理机制。具体而言,利益平衡导向下的有限竞争机制同网络运营商与集体管理组织为一体的授权机制、基于哈希算法与智能合约的数字版权流转与监管机制共同平衡着知识市场中多元主体的利益分配,为数字版权的集体管理保护提供了新思路与可行的路径。With the development of the Internet,the traditional knowledge market is undergoing tremendous changes.A large number of digital copyright works have emerged on the Internet.Non-member copyright owners have great creative vitality,but there have been more and more problems of stealing others’knowledge achievements and infringing knowledge products.Faced with this challenge,it is difficult for the traditional collective management organizations to maintain the balance of interests of all parties,so they fall into the predicaments of uneven distribution of interests.It is found that a brand-new management mechanism can be established by the blockchain technology,which can realize the effective management of the collective management organizations in the whole process of authorization,circulation,supervision and competition in the digital age.Specifically,the limited competition mechanism under the guidance of interest balance,the authorization mechanism integrating network operators and collective management organizations,and the digital copyright circulation and supervision mechanism based on hash algorithm and smart contract balance the interest distribution of multiple subjects in the knowledge market,which provides a new idea and feasible pathways for the collective management and protection of digital copyright.
