公证介入意定监护的路径研究

摘　　要：伴随着我国逐渐进入人口老龄化社会,如何保障老年人口的权益成为当前迫切需要研究的问题。意定监护为我国成年人监护制度改革提供了新思路。结合公证介入意定监护协议的法规依据,分析当前公证介入意定监护的现实困境,提出了相应的发展展望,并结合国内外关于公证介入意定监护的相关经验,提出了更适应中国本土的公证介入意定监护协议的方案,希望为相关人员提供一定的参考与借鉴。With China gradually entering an aging population society,how to protect the rights and interests of the elderly population has become an urgent issue that needs to be studied.Intentional guardianship provides new ideas for the reform of adult guardianship in China.This article analyzes the current difficulties of notarial intervention in voluntary guardianship based on the regulatory basis of notarial intervention in voluntary guardianship agreements,proposes corresponding development prospects,and combines relevant experience of notarial intervention in voluntary guardianship at home and abroad to propose a more localized plan for notarial intervention in voluntary guardianship agreements in China,hoping to provide some reference for relevant personnel.
