律师的角色定位与规模控制——与美国和日本比较

摘　　要：近年我国律师规模处于井喷式发展阶段,但律师角色定位与职业性存在模糊不清、定位不明的问题,律师规模的增长与现有律师执业环境、律师业务水平以及律师市场需求之间呈现不匹配的状态。从美日律师发展路径的经验和教训中,可以窥视出我国律师行业规模快速扩张所产生的问题,建议控制律师数量增长进程,明晰律师角色定位,提升律师素质,使律师行业有序地与市场匹配。In recent years,the scale of lawyers in our country has been at the stage of development by spurt.However,the role positioning and professionalism of lawyers in our country are ambiguous and the positioning is unclear.The growth of the scale of lawyers does not match the existing practice environment,business levels and market demand of lawyers.From the experience and lessons of the development path of lawyers from the US and Japan,we can peek out the problems arising from the rapid expansion of the scale of China's legal profession.It is suggested that the process of growth in the number of lawyers be curtailed and controlled,the role of lawyers be clearly defined,and the quality of lawyers be improved,so as to orderly match the high-quality legal profession with the market.
