地方立法“不抵触原则”的实施与路径优化

摘　　要：地方立法“不抵触原则”,是指地方立法必须以宪法为依据,不得同宪法相抵触;要与国家立法保持一致,不得违反上位法;不得超越法定权限。坚持地方立法“不抵触原则”的价值在于维护法制统一、防止地方本位和保护主义、保护公民合法权益和提高地方立法效益。“不抵触原则”蕴含了其在地方立法原则中居于排他性地位、规制地方立法权无序扩张、通过立法监督克服地方立法冲突、队伍建设是地方立法的组织保障等基本命题。地方立法冲突包括地方立法直接冲突、地方立法间接冲突和多重复杂冲突。为此,应当根据地方立法不抵触的条件设定,通过树立地方立法不抵触的底线思维、恪守地方立法权限、完善与强化地方立法监督和加强地方立法队伍建设等措施,健全和优化地方立法“不抵触原则”。The principle of non-conflict of local legislation means that local legislation must be based on the Constitution and must not contradict the Constitution;Be consistent with national legislation and not violate superior laws;Do not exceed statutory authority.The value of adhering to the principle of non conflict in local legislation lies in maintaining the unity of the legal system,prevent locality and protectionism,protecting the legitimate rights and interests of citizens,and improving the effectiveness of local legislation.The conditions for realizing the principle of local non conflict lie in clarifying the important position of the principle of non conflict in local legislation,adhering to the legislative authority of local legislative organs,supervising local legislation,and having a high-quality local legislative professional team.Local legislative conflicts include direct conflicts,indirect conflicts,and multiple complex conflicts.Local legislation may have adverse consequences such as disrupting the unity of the legal system,providing legal support for rent-seeking in local legislation,and wasting law enforcement and judicial resources.We should set the conditions for non-conflict local legislation,and realize the principle of non-conflict of local legislation by establishing the bottom-line thinking of non-conflict local legislation,abiding by the authority of local legislation,improving and strengthening local legislative supervision,and strengthening the construction of local legislative teams.
