摘　　要：目前,我国矿业用地制度尚未健全,矿业用地相关法律规定分散在矿产资源、土地管理法律法规中,缺乏法律层面的专门规定。矿业权和土地使用权办理严重脱节,导致小型矿山企业用地困难、违法用地现象尤为严重。单一的供地方式远不能保障矿业用地需求,采矿临时用地管理混乱。由于矿山地质环境保护与土地复垦的事中事后监管不力、激励机制欠缺,土地闲置问题突出。近年来,我国加快矿业用地管理改革,以从根本上解决矿业用地难的突出问题。建议以土地和矿产资源管理改革为契机,建立健全矿业用地法律制度,推进矿业权和土地使用权审批统筹衔接,促进矿业用地供地方式多样化改革,完善矿业用地复垦退出机制,促进废弃矿业用地有效利用。The mining land system is still incomplete in our country.There are no independent regulations for mining land,and the related requirements are included in laws and regulations for mineral resources or land management.The approval of mining rights and land use rights is seriously separated,which leads to illegal land use by small mining enterprises.The single way of land supply is far lagging from the demand for mining land,and the management of temporary mining land is disordered.Due to ineffective supervision and lack of incentive mechanism for mining land reclamation,most of the land is idle after mining.In order to solve these problems,the reform of mining land management in China has accelerated in recent years.It is advised to improve the legal system of mining land under the background of mineral resources and land management reform.The approval of mining rights and land use rights should be integrated,and the ways of mining land supply should be increased.It is also necessary to improve the reclamation mechanism of mining land,which can promote the effective use of abandoned mining land.
