摘 要:日本于2014年出台的《特定农林水产品等名称保护法》标志着日本选择了地理标志专门法保护模式。该部法律有着浓厚的地方振兴和产业发展意图,是日本“地域品牌”战略的延伸。与地域团体商标不同,日本管理地理标志的部门是农林水产省而非特许厅,而且注重保护地理标志的载体而非使用人,因此将产业链下游生产经营者的使用行为作为地理标志限制使用的例外。日本对地理标志管理体制的选择以及地理标志使用范围的扩大,对中国地理标志如何在乡村振兴战略中发挥作用提供了参考。The"Law on the Protection of Names of Specified Agricultural,Forestry and Fishery Products"promulgated in 2014,which marked that Japan's protection of geographical indications has entered the special law protection model.This law has strong intentions for local revitalization and industrial development,and is considered an extension of Japan's"Regional Brand"strategy.Different from regional group trademarks,Japan's Ministry of Agriculture,Forestry and Fisheries is responsible for the management of geographical indications,not the Japanese Patent Office,and pay attention to protecting the carrier of geographical indication rather than the user.Therefore,the using behavior of downstream producers and operators in the industrial chain is regarded as an exception to the restricted use of geographical indications.Japan's choice of the geographical indication management system and the expansion of the scope of geographical indications provide a reference for China take geographical indications to a right position the rural revitalization strategy.
