法庭调解中调解员话语的趋近化研究

摘　　要：法庭调解的过程就是调解员通过话语协商实现双方当事人话语趋近的过程。基于一起工伤赔偿纠纷的庭前调解语料,以Cap的趋近化理论及其构建的STA模型为分析框架,采用定量、定性相结合的研究方法,探究调解员的调解话语如何利用空间趋近、时间趋近和价值趋近资源,说服当事人和谐调解,达成共识。研究结果显示,法庭调解中调解员话语旨在推动可调解话语空间趋近,实现话语说服,达成和解并调解结案。趋近化理论视野下调解员话语的STA三维趋近资源使用频次从高到低依次为空间趋近、时间趋近和价值趋近,三者共同构建调解员话语的合法化效力,旨在推动纠纷调解、“案结事了”,实现“以言治纠”的话语建构。Court-related mediation is proceeded by verbal negotiation to shorten the distance of both parties involved for the final fulfillment of dispute resolution and social harmony.Based on the authentic transcribed mediation data from a workplace injury pretrial case,and from the perspective of Proximization Theory and STA model,this study investigates quantitatively and qualitatively how the mediator strategically persuades both sides to mediate in terms of spatial,temporal,and axiological proximization.It is found that during court-related mediation,the mediator aims to stimulate both sides'mediating desires to mediate the negotiable space,proximize the mediating discourse and finally achieve persuasive functions of the mediator's discourse;the mediator's manipulation of the spatial,temporal,and axiological proximization strategies is of decreasing frequency.Among them,the spatial proximization with a dominant role while the temporal and axiological proximization with an auxiliary role,jointly promote the construction of"mediating space"and establish the legitimized forces in mediation discourse.This study aims at exploring how to achieve the dispute resolution by court-related mediation,total conciliation of conflicts as well as realization of social harmony.
