摘　　要：新时代我国业主集体的规模体量、物权意识及法律定位让业主组织日益受到重视,但因各种因素业主组织化行动仍约束重重。通过文献研究和案例比较分析可以看出作为有限理性人的业主群体在参与小区公共事务治理中仍有大幅改进的空间,业主认知、民情、规模及制度门槛方面既构成现实约束,也是未来实现法律赋予业主自主治理愿景的必要条件。为此,一方面需要业主自身树立“公”民意识,有效克服参与冷漠症,积极培养集体行动的意识与必要的沟通技巧;另一方面也要在强化法治思维的基础上树立“定分止争”的权利观。同时,如果能够适当地简化业主组织的设立程序、调低业主自主治理的制度门槛与协商成本,那对基层社区活力的激发无疑是有益的。In the new era,the scale,awareness of property rights,and legal positioning of homeowners in China have made owners′organizations attract increasing attention.However,due to various factors,the organized actions of homeowners are still heavily constrained.Through literature research and comparative analysis of cases,it can be seen that there is still significant room for improvement in the participation of homeowners as bounded rational individuals in community public affairs governance.The perception,public sentiment,scale,and institutional threshold of homeowners not only constitute practical constraints,but also become a necessary condition for realizing the vision of self-governance granted by law to the owners in the future.To achieve this,on the one hand,homeowners themselves need to establish a sense of"serving public",effectively overcome apathy in participation,and actively cultivate a sense of collective action and necessary communication skills;on the other hand,they need to establish a right perspective of"dividing and stopping disputes"on the basis of strengthening the rule of law thinking.At the same time,if the establishment process of homeowners′organizations can be appropriately simplified,and the institutional threshold and negotiation cost of their autonomous governance can be lowered,it will undoubtedly be beneficial to stimulate the vitality of grassroots communities.
