摘　　要：内蒙古生态博物馆作为中国北方第一座生态博物馆,是对当地非物质文化遗产进行整体性活态传承和保护的有益探索,在一定程度上促进了当地文化和生态环境的协调发展。近年来,内蒙古自治区生态博物馆的发展后继乏力,发展情况不尽如人意,原因是多方面的,从法律视角来看,缺乏法律规范,没有专门的规范约束,社区居民主体地位不明确,利益分配不清晰,是阻碍内蒙古生态博物馆发展的重要因素。借鉴国外生态博物馆建设和运营的先进经验,立足内蒙古生态博物馆建设的实际情况,应当加强地方立法,尤其是利用地级市的立法权或者通过村规民约等形式理顺法律关系,明确社区居民的法律地位,保障相关主体的权利,有效保障和促进内蒙古生态博物馆的高质量发展。As the first ecological museum in the north of China,Inner Mongolia Ecological Museum is a beneficial exploration for the overall living inheritance and protection of the local intangible cultural heritage,which has promoted the coordinated development of local culture and ecological environment to a certain extent.However,in recent years,Inner Mongolia Ecological Museum has not been so well developed owing to the various reasons.From the legal perspective,the lack of legal norms,the lack of special regulatory constraints,the unclear status of community residents,and the unclear distribution of interests are all important factors that hinder the development of Inner Mongolia Ecological Museum.By learning from the advanced experience in the construction and operation of ecological museums abroad,and based on the actual situation of the construction of ecological museums in Inner Mongolia,It is necessary to strengthen local legislation,especially by using the legislative power of prefecture-level cities or through village rules and regulations,straighten out the legal relationship,clarify the legal status of community residents,protect the interests of relevant subjects so that the high-quality development of ecological museums in Inner Mongolia by legal means can be effectively guaranteed and promoted.
