论行政应急性原则的适用路径

摘　　要：司法实践中,行政应急性原则的适用呈现出混乱局面,并同现有理论相冲突。作为紧急状态下公权力行使依据的行政应急性原则应遵守特殊的处理规则。对此需通过阶段的划分明确行政应急性原则同一般规则或规则之间的冲突模式并加以解决。在解决方法上,阿列克西的原则权衡理论可资借鉴,但应注意将其引入行政法领域的适当性并避免对重力公式的僵化运用。行政应急性原则适用路径的具体步骤应为:首先,确立某原则的受损害程度;其次,确立行政应急性原则出场后是否适用,若应适用则进入下一步并确立其重要程度,若不应适用则不得突破现有规则;最后,对比两原则之间的程度以此作出优先适用的判断,但应注意另一原则并非绝对排除。In judicial practice,the application of the administrative emergency principle presents a chaotic situation,and conflicts among the existing theories.The principle of administrative emergency used as the basis for the exercise of public power in an emergency should abide by the special handling rules.It is necessary to clarify the conflict patterns between administrative emergency principles and general rules or rules through the division of stages.In terms of solution,Alexey's principle balance theory can be used for reference,but attention should be paid to the appropriateness of introducing it into the field of administrative law and avoid the rigid application of gravity formula.It is necessary to summarize the specific steps to extract the application path of the principle of administrative emergency.First,it should establish the degree of damage of the principle.Secondly,it should establish the application of the principle after the appearance,take the next step and present the importance,if not,do not break the existing rules.Finally,it should compare the degree between the two principles,but note that the other principle is not absolute exclusion.
