摘 要:法政策是追求政策目标的法律规范,法政策学是研究法政策创制的学问。法政策学的学科共识或作业模型由“目的-手段”思维确定的三个步骤构成,即法政策目标的设定、法政策手段的选择、目标与手段的适配。但是,目前法政策学并不完全是交叉学科,而更多地表现为汇集在“作为政策手段的法律”这一主题下的问题集合。除了规范创制之外,法政策的表述在研究法律适用的法教义学中亦不罕见。法政策学以法政策考量的形式参与教义学体系的建构,在法学方法论中表现为目的论要素和后果论证两个方面。Legal policy is a legal norm that pursues policy goals and legal policy studies is the study of the creation of legal policy.The disciplinary consensus or operating model of legal policy is drawn from the three steps of“ends-means”thinking:the setting of legal policy goals,the selection of legal policy instruments,and the adaptation of goals to instruments.At present,however,studies of legal policy are not a fully interdisciplinary discipline,but rather a collection of issues brought together under the theme of law as a policy instrument.In addition to norm creation,the term legal policy is not uncommon in legal doctrine,which is the study of the application of the law.Legal policy participates in the construction of the doctrine system in the form of legal policy considerations,and it is manifested in two aspects of teleological elements and consequential argumentation in legal methodology.
