摘　　要：随着AI现象级产品ChatGPT的面世和中国“数字经济20条”的出台,数字经济发展及其治理体系的演进都迎来了全球新一轮的关注。中国数字经济治理体系伴随着数字经济发展,已经走过了20余年的历程,包含了从诱致性制度变迁,到强制性制度变迁,再到诱致性制度变迁的一轮完整的制度变迁阶段。这三个阶段中,政府、企业和消费者三方博弈的焦点众多,但核心却集中于个人信息保护、数据财产权、反垄断与反不正当竞争以及国家数据安全等四个方面。围绕这四个关键问题,按照诺斯的经济史研究思路,对中国数字经济治理体系的三个阶段展开分析与反思,回顾20年数字经济治理体系的特征并对其进行阶段概括总结,有助于以史为鉴,瞻望中国数字经济治理体系演进趋势,为政策制定者进行超前制度安排、企业战略进行制度适应和后续理论研究提供参考。With the advent of the AI phenomenon product ChatGPT and the introduction of China's“Digital Economy 20”policies,global attention has been renewed for the development of the digital economy and its governance system.China's digital economy governance system has undergone more than 20 years of evolution,encompassing a complete round of institutional changes from inducement-based system changes to mandatory system changes,and back to inducement-based system changes.In these three stages,the focus of the tripartite game between the government,enterprises,and consumers is diverse,but the core issues concentrate on four aspects:personal information protection,data property rights,antitrust and anti-unfair competition,and national data security.Centering around these four key issues,an analysis and reflection on the three stages of China's digital economy governance system is carried out according to Douglass C.North's economic history research approach.Reviewing the characteristics of the digital economy governance system over the past 20 years and summarizing its stages can serve as a historical mirror to predict the evolution trend of China's digital economy governance system.This will provide references for policymakers to make forward-looking institutional arrangements,for businesses to adapt to the system,and for subsequent theoretical research.
