摘 要:RCEP于2023年6月2日对15个签署国全面生效。特殊与差别待遇是RCEP的一项基本原则,公平原则是特殊与差别待遇条款的法理基础。程序公平考察特殊与差别待遇条款的确定性、形式有效性、一致性和相符性,实体公平考察特殊与差别待遇条款的权利义务等内容是否符合分配正义。RCEP中的特殊与差别待遇条款更大程度地体现了公平原则,公平原则在RCEP中的完善也会推动特殊与差别待遇条款在国际层面的整体发展。只有在RCEP的特殊与差别待遇条款实践中进一步发展和完善公平原则理念,才能促进RCEP更加高质量地健康发展。The RCEP enters into full force in the 15 signatory states on June 2,2023.Special and differential treatment is one of fundamental principles in RCEP while the principle of fairness is the legal basis of special and differential treatment provisions.Procedural fairness requires the certainty,formal validity,consistency and conformity of special and differential treatment provisions;substantive fairness requires that the content under special and differential treatment provisions,such as rights and obligations,is consistent with distributive justice.The special and differential treatment provisions in RCEP reflect the principle of fairness to a greater extent,and the improvement of the principle of fairness in RCEP will also promote the overall development of special and differential treatment provisions at the international level.Further development and improvement of the concept of fairness principle in the practice of special and differential treatment provisions of RCEP can promote the healthy development of RCEP in a higher quality.
