境外追逃中劝返措施的法治化建构

摘  要:劝返措施具有适用灵活性、便捷性等优势,已成为具有中国特色的境外追逃措施。但是,劝返措施在法律中缺乏明确规定,实践中的相关法律问题也亟待规范化。作为具有国家意志的执法和司法活动,劝返不宜界定为引渡的替代措施,其适用具有独立性。劝返的主体只能是具有追逃职责的执法和司法机关,其他机关或个人可以成为劝返主体的协助人;宜将劝返的对象限定为中国公民在中国境内实施犯罪后潜逃至他国的刑事外逃人员。劝返中的量刑承诺核心内容应是量刑情节,不宜就具体的刑罚进行承诺,量刑承诺的主体是最高人民法院,量刑承诺的内容应依法兑现;经劝返回国的外逃人员的自首认定应结合投案的阶段判断。Due to flexibility and convenience,return by persuasion has become the main measure on Cooperation Regarding Persons Sought for Corruption,it is advisable to include persuasion in the track of rule of law.As a judicial activity with national will,persuasion should not be defined as an alternative measure for extradition.Its application is independent.The subject of persuasion can only be an organ with judicial responsibilities.Other agencies or individuals can carry out persuasion activities with the authorization of the persuasion subject.It is advisable to limit the object of persuasion to criminal fugitives who fled to other countries after committing crimes in China.The core content of sentencing commitment in persuasion should be the determination of sentencing circumstances,and it is not appropriate to commit to specific penalties.The subject of sentencing commitments is the Supreme People's Court,and the content of sentencing commitments should be fulfilled according to law.The determination of voluntary surrender of those who have been persuaded to return to the country should be combined with the stage of surrender.
