感情投资型受贿的规范本质与体系诠释

摘　　要：关于“感情投资”条款的性质,法律拟制说与注意规定说均存在突破受贿罪之规范构造的问题。该条款应理解为通过法律推定的方式,有条件地将受贿罪的处罚范围由确定影响职权行使的实害犯,扩展到可能影响职权行使的具体危险犯。具体谋利事项获得承诺或实现的“感情投资”,由于危险已然现实化,不适用该条款。作为“可能影响职权行使”与感情投资型受贿的规范指引,权钱交易的具体危险在评价标准上应同时具备行为危险性和结果危险性。“可能影响职权行使”是指国家工作人员违反清正廉洁的行为规范,收受超越礼尚往来范畴的财物,承担相应的权力回报义务,造成职务行为处于被收买的危殆化状态。应区别单向度与双向度的“感情投资”,以确定权钱交易行为危险性的推定规则。犯罪数额是否达到3万元是征表结果危险性的基本要素,故“感情投资”与一般受贿在数额认定上亦不相同。With regard to the nature of the"emotional investment"clause,both the legal fiction and the attention provision have the problem of breaking through the normative structure of the crime of passive bribery,which should be understood as a legal presumption that conditionally extends the scope of punishment for the crime of passive bribery from determining the actual harm that affects the exercise of authority to the specific danger that may affect the exercise of authority.The legal presumption conditionally extends the scope of punishment for bribery from the actual harm that affects the exercise of authority to the concrete danger that may affect the exercise of authority.This provision does not apply to"emotional investments"where the specific matter of gain is promised or realized,since the danger has realised.As a guideline for the regulation of"may affect the exercise of authority"and"emotional investment",the concrete danger of trading between power and money should be evaluated in terms of both behavioral danger and consequential danger."May affect the exercise of authority"refers to the state staff violates the integrity of the code of conduct,accepting property beyond the scope of courtesy,undertaking the corresponding power in return for the obligation,resulting in the behavior of the position in the critical state.In the one-way degree and two-way degree of"emotional investment"situation,the dangerousness of the behavior of power and money transactions in the presumption rules are different.Whether the amount reaches 30,000 yuan is the basic element of the dangerousness of the result,so the amount of"emotional investment"is different from the general bribery.
