反向刷单刑事规制的规范分析与路径选择

摘　　要：反向刷单具有严重的法益侵犯性,并非正常商业竞争行为,仅通过行业自治与民事、行政制裁无法有效控制该行为的发生与蔓延,适用刑事手段处理反向刷单具有重要意义。在增设妨害业务罪以专门规制反向刷单行为之前,结合网络时代的新发展,通过扩大解释与同质解释的方法,不难发现反向刷单行为构成破坏生产经营罪与损害商业信誉、商品声誉罪的想象竞合。惩治反向刷单犯罪行为人时要充分发挥罚金刑的优势,结合刑事禁止令与职业禁止的适用,有效预防其再次实施反向刷单行为。Reverse click farm has serious legal interest infringement,and it is impossible to effectively control the occurrence and spread of this act only through industry autonomy and civil and administrative sanctions,and it is of great significance to use criminal means to deal with reverse click farm.Before adding the crime of obstructing business to specifically regulate reverse order brushing,combined with the new development of the Internet era,it is not difficult to find that the reverse order brushing behavior constitutes the imaginary competition between the crime of damaging production and operation and the crime of damaging business reputation and commodity reputation.When punishing criminals who commit this act,it is necessary to give full play to the advantages of fines and penalties,combined with the application of criminal prohibition orders and professional prohibitions,and effectively prevent criminals from carrying out reverse click farm behavior again.
