摘 要:规划管制是政府基于土地的公共属性而采用公权力来对空间资源支配、干预、使用的重要手段,会对土地产权产生影响并引起土地价值的升降。关注规划管制导致土地损失补偿与增值收益捕获的美国经验,以纽约哈德逊广场更新为例阐释纽约市政府如何通过警察权对城市空间进行规划管制,分析在规划管制对土地价值提升和限制两种情形下的影响调节策略。随着我国逐步进入城市更新阶段,统筹协调规划管制、土地产权和土地价值影响调节三者关系显得尤为重要。借鉴美国经验,我国应明确开发权是规划管制的对象,在规划管制中完善土地价值调节的协商、激励机制。Planning regulation is an important means for the government to use public power to control,intervene and use space resources based on the public property of land,which will have an impact on land property rights and cause the rise and fall of land value.This paper focuses on the American experience of land loss compensation and land value capture caused by planning regulation.Taking the redevelopment of Hudson Yards in New York as an example,this paper explains how the New York City government carries out planning regulation on urban space through the police power,and analyzes the adjustment strategies of land value influence under the two situations of the enhancement and restriction of land value caused by planning regulation.As China gradually enters the urban regeneration stage,overall coordination planning regulation,land property right and land value influence adjustment three relations appear particularly important.Learning from American experience,China should make it clear that development rights are the object of planning regulation,and perfect the negotiation and incentive mechanism of land value regulation in planning regulation.
