摘　　要：村规民约既是村民自治制度的保障,又是村民自治建设的重要体现。然而,村规民约在制定程序、实体内容和审查主体方面存在的问题导致其侵害村民合法权益的情况时有发生,为保证自身权益,村民会寻求司法救济,从而使司法介入到村规民约实施过程当中。村规民约的实施属于村民自治范围,法律没有明确司法能否介入其中。为保证村民的合法权益,解决村规民约存在的问题,有效处理涉及村规民约的纠纷,需要明确村规民约实施过程中司法能否介入,以及介入的基本原则和具体限度,并对司法介入全过程进行监管。Village rules and regulations are not only the guarantee of the villagers'self-governance system,but also the concrete embodiment of the villagers'handling of their own affairs.However,the problems of the village rules and regulations,such as rule making proceeding,entity content and review subject,can lead to the infringement of the legitimate rights and interests of the villagers from time to time.In order to ensure their own rights and interests,the villagers will seek judicial remedy,which means the administration of justice will interfere in the implementation of village rules and regulations.The implementa tion of village rules and regulations is part of villagers'autonomy,and the law does not specify whether judicial have the right to interfere in this.Only by clarifying whether the judiciary can intervene in the implementation of the village rules and regulations,figuring out the basic principles and specific limits of the judicial intervention while supervising the whole process of judicial intervention at the same time,can we protect the legitimate rights and interests of villagers,solve the problems existing in the village rules and regulations as well as effectively deal with disputes involving the village rules and regulations.
