台湾地区私立高校退场中的公权力干预及其困境

摘　　要：台湾地区公权力部门经过较长时间的摸索和实践,建立起行政调控与法律规制共构的私立高校退场机制。直接干预与间接干预并行的“强干预”职能模式昭示着公权力部门管制私立高等教育的行为边界迈进了一大步。相对规范的退场程序、较为完善的配套措施、公开透明的高校信息披露制度、多元权力制衡的退场运行模式,对于纠正台湾地区高等教育市场失灵、改善私立高校退场乱象、保障教育公益属性将起到正面作用。如何统一价值理性与工具理性、平衡公益属性与多元利益、协调被动应急与长远规划之间的关系,则是公权力部门需要重点加以解决的问题。Following extensive exploration and trials,Taiwan’s region public authorities have successfully established a private-university exit mechanism that combines administrative regulation and legal control.This“strong intervention”functional model,characterized by parallel direct and indirect interventions,represents a significant advancement in the scope of public authorities’control over private higher education.The implementation of relatively standardized exit procedures,comprehensive supporting measures,an open and transparent university information disclosure system,and an exit operation model with multiple checks and balances will play a crucial role in rectifying the shortcomings of Taiwan’s region higher education market,addressing the challenges surrounding private college exits,and safeguarding the public welfare attributes of education.To further enhance the private-university exit mechanism,Taiwan’s region public power entities need to tackle the following issues:harmonizing value rationality and instrumental rationality,striking a balance between public welfare attributes and diverse interests,and coordinating the relationship between reactive emergency response and long-term planning.
