新一轮宅基地制度改革试点地区资格权探索与分析

摘　　要：宅基地资格权是宅基地“三权分置”改革设置的新型权利,是当前理论研究和改革试点实践关注的重要内容之一。然而,当前有关宅基地资格权的理论观点尚未达成共识,改革试点地区的具体实践操作多样。基于新一轮宅基地制度改革104个试点县(市、区)和3个地级市的改革实践,全面梳理宅基地资格权实现情况,归纳总结其实现困境与争议。研究结果表明,试点地区有关宅基地资格权的认定标准不一致,资格权实现面临困境。要破解宅基地资格权的实践困境与争议,应从明确宅基地资格权主体认定标准、规范宅基地资格权权能内容、完善宅基地资格权确权颁证机制、构建宅基地资格权多元化实现路径、健全宅基地资格权退出机制等方面入手。Homestead qualification right is a new type of right set up in the reform of homestead"separation of rights"which is one of the important theoretical research and pilot practice.However,there is no consensus on the theory and diverse practical practices.Based on the reform practice of 104 pilot counties(cities,districts)and 3 prefecture-level cities,this paper comprehensively summarizes the realization of homestead qualification right and analyzes its realization dilemma and controversy.It finds that the standard of qualification right of homestead in pilot areas is inconsistent and the realization of qualification right faces difficulties.In order to solve the practical dilemma and dispute,we should clarify the criterion of subject identification,standardize the right content,improve the certification mechanism,construct the diversification path of homestead qualification right and improve the exit mechanism of homestead qualification right.
