摘  要:船舶所有人在受害人与保险人的直接诉讼中所处的地位直接关乎受害人的权益,而《最高人民法院关于适用<中华人民共和国海事诉讼特别程序法>若干问题的解释》第69条关于船舶所有人以无独立请求权第三人身份参与油污责任保险直接诉讼的规定饱受争议,司法实践中对此裁判规则也不尽统一。通过明晰无独立请求权第三人与共同被告的区别,厘清船舶所有人参加直接诉讼中涉及的复杂民事法律关系。通过对船舶所有人在被害人与保险人直接诉讼中的法律地位的分析,明确船舶所有人应当作为共同被告参与直接诉讼,并且应与保险人承担连带赔偿责任。In the direct litigation between the victim and the insurer,the status of the ship owner directly bears on the rights and interests of the victim.Article 69 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of the Law of the People's Republic of China on Special Procedures in Maritime Litigation on the ship owner as a third party without independent claim in the direct litigation of oil pollution liability insurance is controversial,which has led to inconsistency in judicial practice.Through distinguishing between the third party without independent claim and the co-defendant,this paper clarifies the complex civil legal relations participated by ship owner in direct litigation.Based on the analysis of the legal status of the ship owner in the direct litigation between the victim and the insurer,the paper holds that the ship owner should participate in the direct litigation as a co-defendant and bear jointly and severally liable with the insurer.
