对我国网络题库版权治理的思考

摘　　要：网络题库作为智力成果,在具备独创性时,可构成普通的文字作品、特殊的汇编作品、职务作品等,但我国网络题库的版权保护仍面临着“公民的版权意识不强、网络题库的技术性保护措施遭到频繁避开或破坏以及网络题库侵权违法成本低权利人索赔难”的三大困境。为此应加强行政执法和行业自律倒逼公民版权意识提升并加大对网络题库版权技术性措施的法律保护、确立网络题库侵权认定标准和利用惩罚性赔偿追究侵权人法律责任,维护著作权人的合法权益,规范著作权市场秩序。As an intellectual property,online question database can be considered as ordinary written works,special compilation works,and job-related works when they possess originality.However,the copyright protection of online question database in China is facing three major challenges:citizens’weak copyright awareness,frequent evasion or destruction of technical protection for online question database,and low costs for infringement but severe difficulties to claim compensation.Therefore,it is necessary to strengthen administrative law enforcement and industry self-discipline to promote citizens’copyright awareness,increase legal protection for the technical measures of online question database copyright,establish standards for the judgement of infringement,and investigate copyright infringers for legal responsibility through punitive compensation,so as to protect the legitimate rights and interests of copyright owners and regulate the copyright market order.
