收买被拐卖的妇女、儿童罪法定刑配置之反思与展望——以人格权法益为视角

摘　　要：人格权是以民事主体全部人格利益为标的的概括性权利。通过交易的方式把“人”作为“物”买卖,收买被拐卖的妇女、儿童的行为严重违背了民事主体作为人的人格尊严的要求,且基于收买行为形成的各种依附或婚配等关系又侵害了人格权的价值内涵。将收买被拐卖的妇女、儿童罪的保护法益确定为人格权更精准符合法教义学对本罪条文的解释。本罪的法定刑配置偏低和轻缓问题,使得现有刑罚设置既不能正确评价本罪所保护之法益,又造成了《刑法》体例上的矛盾和混乱,无法发挥立法对司法和执法活动的指引作用。3年以下的基本法定刑设置可适当提升至5年以下,同时配置加重法定刑,以期有效遏制收买被拐卖的妇女和儿童这一犯罪行为,维护社会公平正义。Personality rights are comprehensive rights that aim to protect the overall interests of civil sub⁃jects.They typically include freedom of person,dignity,independence,and equality.The act of purchasing and selling women and children through transactions violates the requirement of personal dignity for indi⁃viduals as subjects of civil law.Furthermore,various attachment or marriage relationships formed based on the purchasing behavior infringe upon the value connotation of personality rights.It is more accurate to de⁃termine the protection of legal interests for the crime of buying trafficked women and children as personal⁃ity rights,which is in line with the interpretation of the provisions of this crime by jurisprudence.The cur⁃rent low and light punishment provisions for this crime result in an inability to properly evaluate the pro⁃tected interests it aims to safeguard,which caused inconsistencies and chaos within the legal system,mak⁃ing it difficult for legislation to provide appropriate guidance for judicial and law enforcement activities.Raising the basic fixed-term penalty from three years to less than five years while increasing the severity of the fixed-term penalty can effectively curb the crime of purchasing trafficked women and children and maintain social fairness and justice.
