推进地方黄河河道保护立法的认识与思考——以《鄂尔多斯市黄河河道管理条例》为例

摘　　要：本文以《鄂尔多斯市黄河河道管理条例》为例,从立法框架和重要制度等方面分析了《条例》的立法经验和成效,对黄河流域各地推进河道保护地方立法提出认识与思考。总体上,地方黄河河道保护立法应贯穿生态优先和严格保护理念,细化量化相关上位法规定,解决黄河河道管理的突出问题;做好与《黄河保护法》衔接,充分吸收借鉴河道管理成功实践和立法成熟经验,提高立法的针对性、实用性和科学性。This Taking the<Ordos Yellow River Watercourse Management Regulations>as an example,this paper analyses the legislative experience and effectiveness of the Regulations from the perspectives of legislative framework and significant systems,and also proposes understanding and thinking on the promotion of local legislation on watercourse protection in various places of the Yellow river Basin.Generally speaking,the local legislation on the protection of Yellow River watercourse should run through the concept of ecological priority and strict protection,refine and quantify the provisions of the relevant upper laws,and solve the outstanding problems of Yellow River watercourse management;In addition,we should perform well in the connection with<Yellow River Protection Law>,fully absorbing the successful practice of river management and legislation of mature experience,and improve the pertinence,practicability and scientific nature of legislation.
