新《档案法》背景下的地方档案立法:亮点与启示——以三省区市《档案条例》为例

摘　　要：新修订的《中华人民共和国档案法》已于2021年1月1日起正式施行。为贯彻落实新《档案法》的原则和精神,截至2023年3月,上海、甘肃、内蒙古三省区市结合各地实际,相继修订通过本省区市的《档案条例》,确保与新《档案法》进行有效衔接。通过对三省区市《档案条例》的修订内容进行分析,呈现出以下亮点:坚持党对档案工作的领导;坚持立法惠民的价值取向;体现地方档案立法的特色;新增档案信息化建设内容。三省区市的修法实践表明,地方档案立法要遵循地方立法特色原则、提高地方档案立法技术、构建立法质量评价体系等,更好地助推我国地方档案立法规范化、法治化。The newly revised Archives Law of the People's Republic of China has been officially imple⁃mented since January 1,2021.In order to implement the principles and spirit of the new Archives Law,as of March 2023,Shanghai,Gansu province,and Inner Mongolia Autonomous Region have successively re⁃vised their local Archives Regulation in combination with local realities to ensure effective connection with the new Archives Law.Through the analysis of the revised content of these Archives Regulations,the following highlights are presented:adhering to the leadership of the CPC over archives work;adher⁃ing to the value orientation of legislation benefiting the people;embodying the local characteristics in lo⁃cal archives legislation;adding archives informatiza⁃tion to local legislation.The practice of amending Ar⁃chives Regulations in Shanghai,Gansu province,and Inner Mongolia Autonomous Region has shown that local archives legislation should follow the principles of local legislative characteristics,standardize legisla⁃tive expression,and establish a legislative quality eval⁃uation system to better promote the standardization and legalization of local archives legislation in China.
