摘　　要：合法性是法学基本概念之一。规范是能够发挥指引与评价功能的最小法律构成要素,故最小合法性即合规范性。合规范性是规范与事实构成的关系属性。规范指使人该当做什么,它们不像命题那样描述世界,也不能像命题那样被事实符合。从字面上看,合规范性是行为者遵从规范造成的事实契合规范,但难题在于事实与规范在何处相符?合规范性究竟指的是什么?根据规范非认知主义(表达主义)与可能世界语义等原理可断定:规范的异名同实体是有权立规主体按照既定方式通过规范性语句表征的规定性事态。这种规定性事态就是事实契合规范之处。进而根据事实与事态的例示关系,即可界定合规范性的事态例示概念——行为者遵从规范所造成的事实是规范所表征规定性事态的例示。Legality is one of the basic concepts in jurisprudence.Norm is the minimum component with the function of guiding and evaluating on human action,so that the minimum legality is the property of facts fitting with norms.The property is one of relational property between norm and fact.Norms could be used to prescribe what people should do,but they do not describe the world as propositions do,nor can they be agreed with facts as propositions do.On the literal meaning,the property of Fact Fitting with Norm is the fact brought out by the actor's action compliance with the norm.But the problem for defining the property of Fact Fitting with Norm,it is to find out where the facts could fit with norms,and what is the exact nature of it?According to the principles of Model non-cognitivism and possible world semantics,the synonym of norm is the prescriptive state of affairs represented by normative sentences that declared by competent authorities in accordance with given procedure.This prescriptive state of affairs is the place that fact fitting with norm.Based on the above propositions,The instantiated property of Fact Fitting with Norm is that the fact made by the actor's intentional action to enforce norms,which is the instantiation of the states of affairs prescribed in norms.
