摘 要:国际诉讼中,临时措施是非常重要的工具。近年来,国际法院案件当事方频繁请求指示临时措施,享有自由裁量权的国际法院几乎都会指示临时措施,这使得作为“附带程序”的临时措施几乎成为国际法院的“标准程序”。从某种角度看,这种发展趋势背离了临时措施的初衷,成为案件启动国的诉讼策略工具。在此背景下,研究国际法院指示临时措施过程中需要考虑的核心问题,诸如临时措施的具体过程、双重目的、管辖性先决条件、情形需要以及法律拘束力等,不仅可以加深理解国际法院临时措施制度的理论基础,而且可以认识到该制度存在被滥用的可能。Provisional measures are a very important tool in international litigation.In recent years,the litigants to International Court of Justice have frequently requested the indication of provisional measures,and the ICJ which enjoys discretionary power has almost always indicated provisional measures,which has made provisional measures,as an incidental procedure,the standard procedure of the ICJ.From a certain point of view,this trend deviates from the original purpose of provisional measures and becomes a litigation strategy tool for the country that initiated the case.In this context,a review of the core issues to be considered in the process of the ICJ's indication of provisional measures,such as the concrete process of provisional measures,their dual purpose,jurisdictional prerequisites,circumstances so require,and their legally binding force,will not only deepen the understanding of the theoretical basis of the ICJ's provisional measures system,but also will make it possible to recognize the potential for abuse of the system.
