论党政联合发文的本质特征、现实困境与完善路径

摘　　要：党政联合发文是独具中国特色的一种法治现象,卢曼的社会系统理论为我们理解党政联合发文提供了新的视角。在社会功能分化的背景下,我国的“党”“政”系统在“运作封闭”与“认知开放”的基础上形成了结构耦合的关系。在此种政治实践中,党政联合发文具有一定的合理性和必然性,可以被视为“党”“政”系统的耦合机制,有助于加强二者间的信息共享、确保党的高效治理和政府决策的科学有效。但与此同时,党政联合发文还存在不完善之处。对此,需要在中国特色社会主义法治体系的框架内,对党政联合发文的规范属性、权力边界、备案审查等问题进行厘清,以进一步推动党政联合发文的规范化与法治化。The Party and the government jointly issuing documents is a legal phenomenon with unique Chinese characteristics.Luhmann's social system theory provides a new perspective for us to understand the joint action of the Party and the government.Under the background of social function differentiation,China's “Party” and “government” system has formed a structural coupling relationship on the basis of “closed operation” and “cognitive opening”.In this political practice,there are certain rationality and inevitability in the Party and the government jointly issuing documents,which can be regarded as the coupling mechanism of the “Party” and “government” system conducive to strengthening the information sharing between the two and ensuring the efficient governance of the Party and the scientific and effective government decision-making.But at the same time,there are some points to be improved in the Party and the government jointly issuing documents.In this regard,within the framework of the socialist rule of law system with Chinese characteristics,it is necessary to clarify the normative attributes,power boundary and recording review of the Party and the government in jointly issuing documents,so as to further promote the standardization and rule of law in the Party and the government's joint issue of documents.
