摘 要:中国法理学理论研究与人才培养再出发需要系统化提炼不足、凸现成就的载体,型构理想的法理学教材属于入口之一。因应法学教育需求、立足学术研究前沿、接续学科经典教材、融入团队研究特色,陈柏峰教授主编的《法理学》适时推出,并在理论与实务界引发较大反响。蕴于内容中的编写理念:包括但不限于秉持法理中心,摹多维法理学风景;强调多元规范,肯定制定法的地位;力图找回国家,讲述大国治理智慧;融通三分方案,立足通识彰显学理;考量学生需求,尊重知识选择权利。依托此书在内的法理学教材展开研究、教育、学习,坚持从“我注六经”到“六经注我”,即从思考为何是他与它走向不仅阅读他与它的进阶之路有利于实现“知识传授·能力培养·人格塑造”的多维目标,应予重视。The theoretic research and talent cultivation of Chinese jurisprudence need to highlight the carrier of the current achievements,refine the deficiency systematically and ideally build the jurisprudence teaching materials,which should be considered as one of the explorative paths of the reform and advancement.The jurisprudence,complied by Professor Chen Baifeng,meets the demand of legal education,roots in the frontier of the academic research,continues the characteristics of the classical teaching materials and integrates the features of his research team,which has ignited great impact on both the theoretical circle and the practical counterpart.The philosophy of this textbook includes,but is not limited to:(1)insisting on jurisprudence as the center while portraying different aspects of jurisprudence;(2)emphasizing the pluralistic norms of jurisprudence and affirming the status of statutory law;(3)searching for and telling the wisdom of governance of large countries;(4)using a three ̄dimensional approach,with general education as the root and legal theory construction;and(5)considering students'needs and respecting knowledge.This textbook is based on teaching,research,and learning from multiple perspectives,integrating theoretical knowledge and the relationship between learners,all of which shape a path and goal of“knowledge transfer-competence development-personality building”.All these features deserve the attention of all researchers and learners.
