论清代秋审中“救亲情切”认定

摘　　要：“救亲情切”在审案过程中作为可被考虑的减刑因素,秋审条款和奏定章程却没有对具体减刑条件作出明确规定,审判官借助以往成案,再通过比附的方式来断案。在秋审“救亲”成案中,从“亲”之范围、“情切”程度两个方面总结提炼出减刑条件,罪犯在符合减刑条件且无阻却减刑事由时,即可减等处罚。对因救亲致毙侵害犯亲者的罪犯减轻处罚是“孝”和“法”平衡之后的结果,体现传统法律融合人情的特征。减刑条件中“情切”程度的认定对当代正当防卫制度有借鉴意义,主要为不法侵害行为结束时间上的完善。"Saving family with affections" can be considered as a mitigating factor in the trial process.However,the provisions of autumn trial and the rules of conduct do not specify the specific conditions of commutation.Judges rely on previous cases,and then by comparison to decide the case.In the autumn trial of the case of "saving relatives",the conditions of sentence reduction are summarized from the scope of "relatives" and the degree of "feeling".A criminal may have his punishment reduced when he meets the conditions for commutation and the reasons for commutation are unimpeded.The reduction of punishment for the criminal who killed the prisoner because of saving his parents is the result of the balance between "filial piety" and "law",which reflects the characteristics of traditional law integrating human feelings.The identification of the degree of "emotional urgency" in the conditions of commutation of sentence is of reference significance to the contemporary system of justifiable defense,mainly for the improvement of the end time of unlawful assault.
