摘　　要：缘于信息不对称和预重整制度的缺失,我国现行破产法引入旨在拯救企业新生的重整制度在司法实践中效果不佳。基于重整制度之不足,实务界和学界顺势尝试以预重整衔接破产重整,从信息机制角度,构建企业危机早发现的预警制度,实现信息有质有量的供给,以期更好指导企业适用预重整,促进重整顺利推进,并最终使其融入系统完备的破产法重整体系。Because of information asymmetry and deficiency of pre-reorganization system,the reorganization system introduced to China to save enterprises has achieved little effect in judicial practice.Based on the shortcomings of the reorganization system,those of practical field and academic world have tried to link the bankruptcy reorganization with pre-reorganization to reduce the cost of reorganization and improve the efficiency of reorganization from the perspective of information mechanism.They hope that,by constructing the warning system for early detection of enterprise crises,it would be useful to improve the information supply both in quality and quantity,better guide enterprises to apply pre-reorganization,promote the smooth progress of restructuring,and eventually integrate it into the systematic and complete bankruptcy law reorganization system.
