摘　　要：【目的】中医药是中华民族最耀眼的瑰宝,传承与创新始终是中医药发展的两大主题。我国《中医药法》明确要求保护中医药知识产权就是保护创新,其中专利是对中药创新知识保护力度最强的法律手段,应当加强中药专利保护。【方法】从中药专利保护特殊性揭示中药专利保护主要有产品和方法发明专利两大类型,从我国中药专利申请授权现状分析其形成原因,寻求加强我国中药专利保护的远近期措施。【结果】我国中药专利保护历史较短、存在中药创新难度大、两大认识误区和我国专利制度与中药专利保护不相适应等问题。【结论】加强知识产权法律法规宣传教育,培养中药领域知识产权人才是中药专利保护的基础性工作,构建中药专利特别保护制度是中药专利保护的长期性根本措施,总结司法成功经验制定司法解释统一司法标准是近期应当采取的措施。[Purposes]Traditional Chinese medicine is the most dazzling treasure of the Chinese nation.Inheritance and innovation have always been the two major themes in the development of traditional Chinese medicine.Chinese Medicine Law clearly requires that the protection of intellectual property rights of Chinese medicine is to protect innovation,among which patent is the strongest legal means to protect the knowledge of Chinese medicine innovation,and the protection of Chinese medicine patent should be strengthened.[Methods]According to the particularity of TCM patent protection,the main types of TCM patent protection were product and method invention patents,and the causes were analyzed from the current situation of TCM patent application authorization in China,and the measures to strengthen the protection of TCM patent in the near future were sought.[Findings]Since the history of TCM patent protection in China is short,there are some problems,such as the difficulty of TCM innovation,two misunderstandings and the incompatibility of Chinese patent system with TCM patent protection.[Conclusions]Strengthening the publicity and education of intellectual property laws and regulations and training intellectual property owners in the field of TCM are the basic works of TCM patent protection.The establishment of a special protection system for TCM patent is the long-term fundamental measure of TCM patent protection.The recent measures should be taken to sum up successful judicial experience and formulate unified judicial interpretation standards.
