网络文学版权治理困境及版权制度应对刍议

摘　　要：通过分析我国网络文学版权发展现状和版权治理困境,从法律层面提出应对策略。我国网络文学版权发展存在生产环节抄袭现象屡禁不止,流通环节传播侵权泛滥成灾,消费环节公众偏好免费阅读等现状,导致网络文学版权治理存在困境,着重体现在网络文学作品价值与版权保护强度间的理论困境、网络文学版权侵权与司法救济机制间的实践困境,以及网络文学版权侵权与损害赔偿制度间的平衡困境。文章从法律层面提出治理网络文学版权困境的策略:重构网络文学版权利益平衡机制、完善网络文学版权侵权赔偿制度、重视网络文学版权作品登记制度、强化对版权技术保护措施的立法保护,以建立符合时代发展的网络文学版权保护制度和规则,为网络文学的发展保驾护航。By analyzing the current situation of the development of online literature copyright in China and the difficulties in copyright governance,the corresponding strategies are proposed from a legal perspective.The current situation of the development of online literature copyright in China includes the following issues:the repeated prohibition of plagiarism in the production process,the rampant spread of infringement in the circulation process,and the public's preference for free reading in the consumption process.This leads to the difficulties in the governance of copyright in online literature,which are manifested in the theoretical dilemma between the value of online literary works and the intensity of copyright protection,the practical dilemma between the online literary copyright infringement and the judicial relief mechanisms,and the balance dilemma between the online literary copyright infringement and the damage compensation systems.This article proposes strategies to address the dilemmas of online literature copyright from a legal perspective:restructuring the mechanism for balancing the interests of online literature copyright,improving the compensation system for online literature copyright infringement,emphasizing the registration system for online literature copyrighted works,and strengthening the legislative protection for copyright technology protection measures.The establishment of the copyright protection system and rules for online literature that are in line with the development of the times can safegard the development of the online literature.
