黑社会性质组织侦控对策的完善——基于社会治理视角

摘　　要：我国扫黑除恶专项斗争已进入常态化阶段,在侦控黑社会性质组织的过程中,出现了对多元社会主体的积极作用发挥不够、涉黑组织被打击后卷土重来等问题。因此,要从社会治理视角下完善侦控对策,加强对黑社会性质组织的系统治理、依法治理、综合治理和源头治理。在侦查方面,要把握非法控制作为黑社会性质组织的本质特征,查明团伙的经济实力和主要业务,判断其是否具有保护伞,严格区分黑社会性质组织和恶势力团伙。同时,要完善证据链条,异地用警异地关押,破除犯罪分子侥幸心理,积极发动群众,拓宽涉黑线索来源,从而实现对黑社会性质组织的有效打击。At present,the specialized campaign of crackdown on gang crimes has entered the long-term stage.In the process of investigating and controlling of gang-related organizations,some problems have emerged,such as the low efficiency of the positive role of diverse social entities and gang-related organizations reemergence after being cracked down.Therefore,we should improve the investigation and control countermeasures from the perspective of social governance,and strengthen the systematic governance,governance according to the law,comprehensive governance,and source governance of criminal organizations.In terms of investigation countermeasures,we should grasp the essential characteristics of criminal organizations,find out the economic strength and main business of the criminal organizations,judge whether it has a protective umbrella,and strictly distinguish between evil force criminal gangs and gang-related organizations.At the same time,we should perfect the chain of evidence,use police in different places to investigate and handle criminal organizations,prevent criminals from taking chances,actively mobilize the masses,and broaden the sources of criminal organizationsrelated clues,so as to achieve an effective crackdown on criminal organizations.
