湖南省水资源使用权确权登记法律制度研究

摘　　要：水流产权确权是加快推进生态文明建设的重要内容,对水权进行初始分配是水权确权登记工作的重要环节,对此,湖南省积极落实国家有关政策进行试点。然而,湖南省水资源使用权确权登记法律制度的构建仍然在起步阶段,存在登记机关主体权责不明、确权登记范围划定困难、登记程序不规范等问题。如何解决这些问题并完善湖南省水资源使用权确权登记法律制度的构建,是摆在我们面前的重点问题。通过明确湖南省水资源使用权确权登记机关权责、细化湖南省水资源使用权确权登记程序、修改制定湖南省水资源使用权确权制度上位法规,加强法律构建,进行立法建设,才有利于完善我省水资源使用权确权登记制度的构建,并推进水权市场化交易。Water flow property right is to accelerate the construction of ecological civilization.The initial allocation of water right is an important part of the water rights registration work.Hunan Province actively implements the relevant national policy deployment of important initiatives for the pilot.However,the construction of the legal system for the registration of the right to use water resources in Hunan Province is still in its infancy.How to solve these problems and improve the construction of the legal system of the right to use water resources in Hunan Province is a key issue in front of us.By clarifying the rights and responsibilities of the authorities in Hunan Province,refining the registration procedure of water resources in Hunan Province,revising and formulating the superior laws and regulations of water resources in Hunan Province,strengthening the legal framework and carrying out the legislative construction,it is conducive to improving the construction of water resources in Hunan Province,and promoting the market-oriented trading of water rights.
