摘 要:台湾地区现行“国籍”制度默许台湾地区居民拥有双重“国籍”,使部分台湾地区居民在事实上拥有双重“国籍”,导致台湾地区居民“国籍”问题比较复杂。从“一国两制”方针在香港地区的实践经验来看,两岸和平统一后,台湾地区居民的“国籍”问题必须作适当处理。鉴于回归前香港地区居民国籍问题的复杂性,全国人大常委会以立法解释的方式对《中华人民共和国国籍法》在香港特别行政区的具体实施作了变通规定,灵活处理了香港地区居民的国籍问题,保障了香港地区顺利回归。两岸和平统一后,可借鉴处理香港地区居民国籍问题的经验,充分考虑潜在风险,根据现实情况对台湾地区居民“国籍”问题作出合情合理安排,维护台湾地区社会稳定和长治久安。The current“nationality”system in Taiwan tacitly allows Taiwan residents to have dual“nationalities”,which makes some Taiwan residents have dual"nationalities"in fact.As a result,the issue of“nationality”of Taiwan residents is rather complicated.Based on the practical experience of One Country,Two Systems in Hong Kong,the issue of“nationality”of Taiwan residents must be appropriately handled after the peaceful reunification of the two sides of the Strait.In view of the complexity of the nationality issue of Hong Kong residents before the return,the Standing Committee of the National People's Congress made flexible provisions for the specific implementation of the Nationality Law in Hong Kong through legislative interpretation,which flexibly solved the nationality issue of Hong Kong residents and ensured the smooth return of Hong Kong.After cross-Strait peaceful reunification,we can learn from the experience of dealing with the nationality issue of Hong Kong residents,take a full account of potential risks,and make reasonable arrangements for the nationality issue of Taiwan residents according to realities,so as to maintain the social stability and long-term stability in Taiwan.
