摘　　要：从公私权益、湾区意识以及数字时代三个向度层层递进,可联动证成粤港澳大湾区体育非物质文化遗产知识产权协同保护的制度理性。然而,知识产权的地域性和知识产权的差异性阻碍了粤港澳大湾区体育非物质文化遗产资源要素的自由流动,进而制约了整体性保护的实效。为协同保护大湾区体育非物质文化遗产的知识产权,粤港澳可从立法、行政、救济三重向度循序展开。首先,立法理念、立法形式、立法主体等立法元素需要互动与交融,确保立法及时回应粤港澳大湾区体育非物质文化遗产的知识产权保护需求。其次,以形塑多元共治的湾区治理结构为导向,依托知识产权互认机制、知识产权增值机制和数字保护模式,协同建立体育非物质文化遗产知识产权事务协调机制。最后,通过知识产权调解、知识产权仲裁和国务院府际纠纷裁决,系统建构公私合作治理的多元化纠纷解决机制。Public and private rights,consciousness of bay area and the digital times prove that the collaborative protection of intellectual property rights of sports intangible cultural heritage in Guangdong-Hong Kong-Macao Greater Bay Area contains profound institutional rationality.However,at present,this collaborative protection work is facing the dual dilemma of regionality and the intellectual property rights differences.To protect the intellectual property rights of the intangible cultural heritage of sports in the Greater Bay Area,it can be responded from the perspective of legislation,administration and relief.First of all,legislative elements such as legislative concept,legislative form and legislative subject in Guangdong-Hong Kong-Macao Greater Bay Area should be interacted and integrated,so as to ensure the immediate response of protection needs of sports intangible cultural heritage.Secondly,by establishing the intellectual property mutual recognition mechanism,intellectual property and digital protected mode,value-added mechanism of intangible cultural heritage,the coordination mechanism of sports intangible cultural heritage intellectual property affairs with the participation of multi-subject,which contains culture,science and technology,industry and commerce,can be explored into.Finally,through the non litigation dispute resolution mechanism with the participation of multiple subjects and the interregional judicial assistance system guided by the final judgment in Guangdong-Hong Kong-Macao Greater Bay Area,the dispute resolution mechanism of public-private cooperation governance can be built.
